We were released from our 12 month lease (after residing for 7 months) by our apartment complex on April 1 2008. There were no penalties (i.e. owing more rent, etc). We were told the our deposit would be refunded when a new tenant moved in. Now I am told it could be until August, or if the new tenant signs a new one-year lease.
Is this legal? If they released us from our rental obligations (it was their decision), how can they keep our security deposit?
Any help is appreciated.

I would suggest that you check with your state and county. I had a landlord try to pull a fast one on me. I showed him the landlord-tenant manual from my county – he said, "gee, I guess I didn’t do my homework". Most cities and counties have a landlord-tenant relations board.

What does your lease say? If it’s in the lease and you signed it, you’re stuck.

Since you ended your lease early, I do think it’s legal for them to with hold the deposit until the apartment is leased. Probably in the fine print somewhere.

you should have had a written rental agreement when you moved in,,,the terms of your tenancy should be stated in this document,,,if you signed and agreed to it then they can do what they propose…
